This site and Bulletin Board are offered as a community service by the Emerald Forest and Diamond Cove Homeowners Associations.  By using this Bulletin Board you specifically agree that you have read, understand, and agree to the terms of the EMERALDFORESTHOA.COM website, and by proceeding forward you acknowledge you are recording your agreement.

You understand the purpose of the Buena Vista Woods Bulletin Board is to post entries that enable homeowners to sell and solicit items and convenience services (such as babysitting) from other homeowners.  All entries placed on this Bulletin Board are done so directly by the homeowner.  There is no monitoring by the Emerald Forest or Diamond Cove Homeowners Associations of items that appear.  By using this site and accepting the conditions set forth, you are acknowledging all responsibility for continuing forward.  It is NOT a place to post comments, complaints, or opinions, slanderous or otherwise, nor anything that could be considered illegal or offensive to any person, place, business, or group.  Any use deemed inappropriate by the Emerald Forest webmaster, is strictly prohibited.  Should you enter into any prohibited actions, the Emerald Forest webmaster, under the jurisdiction of the Emerald Forest Homeowners Board, has the right to deny access to any individual homeowner.

Use of the Community Bulletin constitutes an agreement that Emerald Forest, Diamond Cove, Buena Vista Woods, its agents, employees, and board members, do not assume any liability for actual, consequential, compensatory, or other damages resulting from use of the Community Bulletin Board.  A posting on the Community Bulletin Board does not mean or imply an endorsement by Emerald Forest, Diamond Cove, Buena Vista Woods, its agents, employees, or Board Members of any of the goods or services offered.  Users of the Community Bulletin Board are advised to use common sense, get referrals from persons known to you, and to conduct necessary criminal and other background checks of persons you may hire to perform household chores, duties, or any other interaction.

EMERALDFORESTHOA.COM does not warrant or make any representations regarding the use or the results of the use of the Website or materials in this Website, or in third-party sites in terms of their correctness, accuracy, timeliness, reliability or otherwise.  You (and not EMERALDFORESTHOA.COM) assume the entire cost of all necessary maintenance, repair or correction.

INDEMNIFICATION AND HOLD HARMLESS AGREEMENT

             YOU, AS THE EMERALD FOREST OR DIAMOND COVE HOMEOWNERS ASSOCIATION MEMBER WHO HAS VOLUNTARILY CHOSEN TO UTILIZE THIS WEBSITE, UNDERSTANDING AND VOLUNTARILY AGREEING TO ALL TERMS OF THIS WEBSITE (HEREINAFTER “MEMBER”), YOU SHALL ASSUME AND BE RESPONSIBLE FOR, AND SHALL INDEMNIFY AND HOLD THE EMERALD FOREST, DIAMOND COVE, AND BUENA VISTA WOODS HOMEOWNERS ASSOCIATION, INC. (HEREINAFTER, “HOA”) HARMLESS FROM ANY AND ALL CLAIMS AND DEMANDS OF ALL PARTIES WHATSOEVER FOR DAMAGES OR FOR COMPENSATION FOR INJURIES OR CAUSES OF ACTION WHICH MAY ACCRUE TO PERSONS, MATERIALS, TANGIBLE, AND REAL PROPERTY DUE OR CLAIMED TO BE DUE, EITHER DIRECT OR INDIRECTLY, TO HOA’S OPERATIONS, OR TO THE ACTS OR OMISSIONS OF HOA, ITS EMPLOYEES, AGENTS, SUCCESSORS OR ASSIGNS, OR ANY EMPLOYED DIRECTLY OR INDIRECTLY BY ANY OF THEM FOR OPERATION OR USE OF THE EMERALDFORESTHOA.COM WEBSITE, INCLUDING, BUT NOT LIMITED TO THE BULLETIN BOARD WHICH IS THE SUBJECT OF THIS AGREEMENT.   SAID DAMAGES AND CAUSES OF ACTION SHALL INCLUDE, BUT NOT BE LIMITED TO, DAMAGES OCCASIONED BY AN ALLEGED ACT OF SLANDER OR LIBEL.  MEMBER SHALL PAY ALL JUDGMENTS OBTAINED BY REASON OF DAMAGES OR INJURIES, INCLUDING ALL LEGAL COSTS, COURT EXPENSES AND OTHER LIKE EXPENSES AND REASONABLE ATTORNEY’S FEES INCURRED IN CONNECTION WITH ANY CAUSE OF ACTION OR DAMAGES ARISING OUT OF OR IN ANY WAY RELATED TO USE OF THE HOA WEBSITE AND BULLETIN BOARD WHICH IS THE SUBJECT OF THIS AGREEMENT.  HOA AND MEMBER, BEING THE PARTIES TO THIS INDEMNIFICATION AND HOLD HARMLESS AGREEMENT EXPRESSLY RECOGNIZE THAT HOA IS NOT REQUIRED TO MAKE THIS WEBSITE AVAILABLE TO ITS MEMBERS AND THIS INDEMNIFICATION AND HOLD HARMLESS AGREEMENT IS THEREFORE A MATERIAL INDUCEMENT FOR HOA AGREEING TO MAKE SAID WEBSITE AVAILABLE FOR USE TO THE GENERAL MEMBERSHIP.  IN ADDITION TO THE FOREGOING, MEMBER SHALL PROMPTLY REMEDY ALL DAMAGES OR LOSS TO ANY PROPERTY OR PERSON CAUSED IN WHOLE OR IN PART BY MEMBER, AND ANY EMPLOYEE, AGENT, OR ANYONE DIRECTLY OR INDIRECTLY EMPLOYED BY ANY OF THEM, ANY GUEST OR UNINTENDED USER OF THIS WEBSITE, WHETHER INVITED BY MEMBER OR NOT, OR BY ANYONE FOR WHOSE ACTS ANY OF THEM MAY BE LIABLE.  MEMBER SHALL BE RESPONSIBLE TO HOA FOR THE ACTS AND OMISSIONS OF ITS EMPLOYEES, SUBCONTRACTORS, AGENTS, REPRESENTATIVES, SUCCESSORS AND ASSIGNS, AND OTHER PERSONS PERFORMING ANY OF THE SERVICES UNDER A CONTRACT, WHETHER WRITTEN OR ORAL, INCLUDING, BUT NOT LIMITED TO, DAMAGE TO ANY PERSONS OR PROPERTY ARISING OUT OF OR IN ANY WAY RELATED TO USE OR DESIGN OF THIS WEBSITE.
